Pakiza — legal

Terms & Conditions

Last updated

An agreement between you and HSR Utility Apps Private Limited, trading as HSR Utility ("we", "us", "our"), governing Pakiza (package com.hsrutility.pakiza) — "the app" below — and the services behind it. Using the app means you accept these Terms and our Privacy Policy. If you do not agree, please do not use the app.

1. What the App Provides

  • A vertical feed of still and live (video) wallpapers, previewing in place.
  • A curated ringtone library to browse, preview and set.
  • Still wallpapers are applied through the app; live wallpapers hand off to Android’s own wallpaper chooser, which asks you where they should go.
  • Reminders — Jummah and Islamic-calendar reminders — scheduled entirely on your device.
  • An upload screen for submitting a wallpaper or a ringtone for review.
  • Localisation into eleven Indian languages, with light, dark and system theming.

Content is served from our systems, so most of it needs a connection, and the catalogue changes over time.

2. Eligibility & Your Account

You must be at least 13, and old enough to enter a binding agreement where you live. To subscribe you must be able to authorise payments — in India a UPI Autopay mandate requires you to be 18, or to have the consent of the guardian holding the payment account.

You sign in with Google, and you are responsible for activity under your account and for keeping that Google account secure. The account is personal to you: do not sell, share or transfer it. You can delete it whenever you want.

3. Licence

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the app on Android devices you own or control, for your own non-commercial use.

Everything in the app — wallpapers, ringtones, artwork, designs, software — is owned by or licensed to us and protected by copyright. Setting a wallpaper or ringtone on your own device is what the app is for; redistributing it outside the app is not. If you believe something in the app infringes your copyright, write to us at the address below.

4. Premium Subscription

What premium unlocks

Browsing and previewing stay free. Premium unlocks applying and sharing wallpapers, and setting ringtones.

Price & billing

₹199 per month in Indian Rupees, through PhonePe, on a UPI Autopay mandate you approve in your own UPI app. Price and period are shown before you subscribe. This is not Google Play billing, so a Play Store refund request will not reach us.

The mandate

Approving it takes a verification debit — currently ₹2 — reversed automatically by your bank. It authorises the mandate; it is not the price of anything.

Free trial

One per person. If you have used yours, subscribing charges you straight away instead. When a trial ends the mandate is charged unless you cancel first, and UPI rules require a pre-debit notification before each debit.

Auto-renewal

Renews monthly until cancelled, taken against your mandate and never above the maximum it authorised.

Cancellation

Any time, from Settings → your plan → Cancel. It stops future charges and leaves premium running to the end of the period you paid for. It refunds nothing already paid.

Deleting ≠ cancelling

Deleting your account cancels the subscription and ends access at once. Time left on the paid period is lost, along with any referral reward days, with no refund. Signing up again restores none of it and grants no new trial.

Price changes

Never retroactive. A change takes effect from your next billing period, with notice in the app first.

PhonePe processes payments under its own terms. We never see or store your card, bank or UPI credentials.

5. Refunds

All payments are final and non-refundable. Not for a change of mind, an unused part of a period, cancelling early, forgetting to cancel before a renewal, or simply stopping. The Refund Policy sets this out in full, together with the one thing that is not a refund question: a charge taken in error.

Nothing here removes a right you hold under Indian consumer law that cannot be given up by agreement.

6. Content You Submit

Submitting a wallpaper or a ringtone confirms you own it or hold every right needed to share it, and grants us a worldwide, royalty-free licence to review, store, adapt and, if approved, publish it in the app. Everything is reviewed before it appears; we may reject or remove any of it, and you can ask us to take yours down.

One consequence is worth stating plainly: if a submission of yours has already been published, deleting your account does not pull it from the app. It stays as anonymous content with no link to you, and you can email us to have it removed.

Submissions must respect the religious and cultural nature of the app, and must never carry someone else's watermark.

7. Acceptable Use

You agree that you will not:

  • Copy, scrape, redistribute or resell wallpapers or ringtones outside the app.
  • Reverse engineer, decompile or tamper with the app, its APIs or its content protection.
  • Bypass premium gating, subscription checks or signed media URLs.
  • Run bots, automation or bulk downloading against our services.
  • Submit content you do not own or have no right to share.
  • Submit content that is unlawful, hateful, sexually explicit, violent, or that disrespects any religion or community.
  • Abuse referrals — fake accounts, self-referral loops, automated redemptions.
  • Use the app in any way that breaks applicable law.

8. Referrals & Rewards

Free premium days for each friend who subscribes through your link, credited on their first payment rather than on install. Rewards are a goodwill benefit: no cash value, not transferable, withdrawable where we detect abuse, and forfeited when an account is deleted.

9. Availability & Termination

We work to keep the service up but do not guarantee uninterrupted or error-free operation. We may add, change or remove features, and if we ever discontinue the app we will give reasonable notice and stop future charges.

We may suspend or terminate your account for a material breach — bypassing premium gating, abusing referrals, misusing our services — warning you first where practical, and with no refund. You may stop using the app or delete your account at any time. Clauses that by their nature outlive the agreement — intellectual property, disclaimers, limitation of liability — survive it.

10. Disclaimers & Liability

The app and its content are provided "as is" and "as available". To the fullest extent the law permits we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement — including that the app will meet your requirements, run on every device, or keep any particular content available.

To the fullest extent the law permits, HSR Utility Apps Private Limited and its team will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of data or profits. Our total aggregate liability for any claim relating to the app is limited to what you paid us in the 12 months before the claim arose, or ₹1,000 if you paid nothing. Nothing here limits liability that cannot be limited under applicable law.

11. Governing Law & Changes

These Terms are governed by the laws of India, and any dispute is subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra. Please contact us before going to court.

We may update these Terms. The "Last updated" date moves when we do, a material change is notified inside the app, and continuing to use the app after that means you accept the updated Terms.
